DETAIL
The painting of a building is
permitted development (Class C, Part 2 of the GPDO) and as such
not subject to the control of the LPA. Consent would be required
if a building is listed (for painting). Planning permission
would be required for a brand new shop front and the Council has
developed guidance for this purpose, particularly where the
premises is in a Conservation Area.
Clearly then, if a new shop front is proposed the LPA would seek
to control appearance through encouraging adherence to the
published shop front guidance and would, as an ultimate
sanction, be able to refuse inappropriate designs. However, in
respect of painting and therefore the colour of existing
frontages, the LPA can exercise little control unless the
building is listed.

DETAIL
I have received a comment
from one of our members about the colour of the shop front on
the unit next to Barclays Bank at the junction of the High
Street, Whitehorse Street and Hitchin Street, which I understand
is to be an Estate Agent.
NHDC are spending c£2.8m trying to generate a new "Town Centre"
and we understood that part of this was to look at the control
of colour on shop fronts to reflect the historical context of
the town centre.
The comment is that this new unit's shop front colour does not
seem to be in keeping with the design of the building and
surrounding area or the aspirations of the Town Centre
Enhancements.
I would appreciate your views on this so they can be conveyed
back to our members. Also, we need some guidance from you on how
we should be dealing with these issues at the planning stage to
prevent this continuing decline in shop front design in the town
centre. Are there any practical restrictions that can be put in
place, or is it a free for all situation?
